We will review a sample trial notebook and discuss the best way to organize it and present it to the court.

We will explore the strategies for the best opening and closing statements, direct and cross examinations of witnesses. We will also discuss how to prepare witnesses for testimony.

We will review sample pre-trial motions and discuss the underlying legal basis, including when they are needed in order to preserve the record on appeal.

We will discuss obtaining discovery from the DA and compelling discovery.

We will review recent NC appellate court decisions in criminal cases and analyze how trial attorneys could’ve revised their strategies to have gotten better results for their clients. We will discuss an amendment that was recently approved by the Supreme Court, trust accounting Rule 1.15-2, that requires checks drawn on a trust account to be signed by a lawyer or by an employee who is not responsible for performing monthly or quarterly reconciliations. He will review general rules and provide other tips for managing trust accounts.

Attorney Peterkin will discuss Non-traditional Custody Cases. He will discuss the evolving laws on grandparents’ rights, same sex couples and adult adoptions.

Attorney Kober will elaborate on GAL representation. She will discuss how to effectively advocate for children. She will also discuss the best strategies for investigating children’s rights issues and how to best interview minors.

Attorney Tanner will discuss tax issues and consequences of divorce, equitable distribution, alimony, child support, adoption and other issues. Primarily, he will focus on helping your client avoid unnecessary tax consequences in divorce proceedings.

Attorney Peterkin will elaborate on ethical issues that relate to the family law practitioners. He will review state bar complaints and ethics opinions that relate to family law attorneys.
